KOUNOUZ EL YASMINE, a limited liability company with its headquarters located at 342 QI SIDI GHANEM ROUTE DE SAFI, MARRAKECH, and registered in the Commercial Register of Marrakech under number 55971, « KOUNOUZ EL YASMINE SARL » develops and markets a line of clothing and accessories under the brand KOUNOUZ, blending traditional Moroccan garments with modern styles. KOUNOUZ EL YASMINE SARL holds the exploitation rights for the brand KOUNOUZ and its associated graphics, registered with the Moroccan Office of Industrial and Commercial Property.
Article 1 : SCOPE
These General Terms of Sale ("GTS") govern all sales of products by KOUNOUZ EL YASMINE. The Client acknowledges having read the GTS available on the website in French, English, and Arabic before placing any order. Any order placed on the kounouz.ma website and validated by the Client implies full and unreserved acceptance of the GTS by the Client.
KOUNOUZ reserves the right to modify the GTS at any time. In such cases, the applicable GTS will be those in force on the date the order is validated by the Client.
Article 2 : WEBSITE USAGE CONDITIONS
Any order made on kounouz.ma constitutes a remote contract between the Client and Kounouz, implying the Client's irrevocable and unconditional acceptance of the GTS.
To place an order, the user declares to have the legal capacity to contract with KOUNOUZ, particularly to be over 18 years old on the date of the order.
The Client may choose among the different languages offered on the website to place an order.
Article 3 : PRODUCT INFORMATION
The kounouz.ma site presents the essential characteristics of the products through photos and detailed descriptions.
Kounouz.ma reserves the right to remove or add items at any time.
Article 4 : ORDER
Contractual information is presented in French, English, and Arabic and will be confirmed at the time of order validation.
The kounouz.ma team reserves the right not to register a payment and not to confirm an order for any reason, particularly in case of supply issues or difficulties with the received order.
Any order placed on kounouz.ma implies acceptance of the GTS.
Confirmation of the order constitutes full and unconditional acceptance of these terms and conditions of sale.
All provided data and recorded confirmation serve as proof of the transaction.
The order confirmation implies acceptance of the operations performed. A summary of your order information will be provided in PDF format via the confirmation email.
Any order confirmed by the Client is final. kounouz.ma acknowledges receipt of the order via email within a maximum of five (5) business days.
kounouz.ma makes every effort to ensure the availability of the offered products. However, they are offered within the limits of available stock. If a product is out of stock, the Client will be informed via email as soon as possible. If the Client’s order was paid for at the time the product became unavailable, the Client may request order cancellation and full reimbursement without additional fees or exchange for another product of the same price as initially ordered.
Article 5 : SHIPPING AND DELIVERY
Prices displayed on kounouz.ma are in Moroccan Dirham (DH) and do not include shipping and delivery fees, which are specified to clients before order validation.
For non-resident clients, shipping fees are calculated based on the delivery location and weight of each order and are the Client's responsibility.
The kounouz.ma team ships international orders through our partner DHL within a maximum
of 10 business days.
For orders within Morocco, delivery is handled by AMANA within a maximum of 5 business days.
Ordered products are delivered within an indicative period of ten (10) business days following full and effective payment of the order by the Client.
Upon dispatch, the kounouz.ma team will provide a tracking number to allow order tracking.
Delivery is made to the address provided by the Client during the ordering process on kounouz.ma. In case of the Client’s absence at the time of delivery, if the Client fails to receive the order, kounouz.ma will no longer be responsible for the order. Consequently, the Client will not be entitled to request a refund or any compensation due to a failed delivery.
Deliveries will only be made to the address indicated on the order form.
Article 6 : PAYMENT
Validating your order implies an obligation to pay the indicated price. For non-resident clients, payment is made by credit card through the secure MAROC TELECOMMERCE system. For residents in Morocco, payments can be made by credit card or cash on delivery.
Product prices are those applicable on the order date, as displayed on the website. Despite the vigilance of the kounouz.ma team, price errors may occur due to IT issues, manual errors, or other technical factors. If an order is placed at an incorrect price, it will be automatically canceled, and the client will be notified promptly. KOUNOUZ reserves the right to modify product prices at any time, without affecting ongoing or completed orders at the time of the price change.
Prices are payable in the currency indicated on the website. Prices are shown excluding shipping fees (which are indicated to the Client at the order summary or quote).
Article 7 : PAYMENT SECURITY
The electronic payment security system established by Maroc Télécommerce/CMI is certified by the Interbank Electronic Payment Center (CMI).
Article 8 : EXCHANGE AND RETURN
The client has a 7-day withdrawal period from the delivery date to return a product, exchange it, or obtain a refund (excluding delivery fees).
To exercise this right, the Client must contact kounouz.ma by email.
Products must be returned:
- In their original packaging.
- In a new, unused condition, suitable for resale.
- With all accessories.
- With intact and attached tags.
Return costs and risks are borne by the buyer. Failure to meet these conditions will be considered a waiver of the right of withdrawal.
Products can be refunded in case of size or color error on the order if a stock shortage prevents an exchange.
In case of return, and upon receipt of the goods by KOUNOUZ, the Client will be refunded within 30 days.
Refunds will be credited to the card used for order payment.
Discounted or promotional items cannot be returned or exchanged.
Article 9 : Customs Fees and Customer Responsibilities
Additional customs duties or taxes may be applied upon receipt of your parcel, depending on your country’s regulations. These fees are not included in the prices listed on our website and are the sole responsibility of the customer.
Once the order has been confirmed and shipped, no refund or return will be accepted in case of parcel refusal or failure to pay the customs fees. In such cases, the parcel will be considered abandoned or destroyed by customs authorities, and we disclaim any responsibility for these charges or the resulting consequences.
Article 10 : WARRANTY - LIABILITY
KOUNOUZ commits to providing the Client with a product that complies with the order after validation.
Kounouz products comply with Moroccan legislation. Kounouz cannot be held liable in case of non-compliance with the legislation of the destination country. It is the Client’s responsibility to verify with local authorities the import or usage possibilities of products or services they intend to order.
Additionally, Kounouz cannot be held liable for damages resulting from improper use of the purchased product.
In case of non-compliance of a product sold, it can be returned to Kounouz for exchange.
Article 11 : FORCE MAJEURE
KOUNOUZ cannot be held liable for any delay in delivery resulting from strikes, lockouts, epidemics, transportation blockages, embargoes, telecommunications disruptions, floods, fires, nuclear disasters, wars, government regulations, or other force majeure events beyond KOUNOUZ’s control, preventing normal performance of the GTS. However, nothing in this clause exempts either party from the obligation to pay any amount owed to the other.
Article 12 : INTELLECTUAL PROPERTY
The website www.kounouz.ma and all its data, texts, information, images, and photographs are the property of KOUNOUZ EL YASMINE SARL, unless otherwise specified, and are protected by intellectual property laws. No data or information from this site may be reproduced, sold, transferred, modified, redistributed, retransmitted, adapted, published, or commercially exploited in any way without prior written permission from KOUNOUZ EL YASMINE SARL.
Any unauthorized use of kounouz.ma’s data or elements constitutes an infringement.
Article 13 : PERSONAL INFORMATION
Before placing an order, the Client must create an account on the website. The Client is solely responsible for maintaining the confidentiality of their password and profile information, releasing kounouz.ma from any responsibility in this regard. In case of loss, kounouz.ma can resend the password upon written request to the registered email address.
Personal data communicated to kounouz.ma is used to process orders, manage commercial relations, and offer KOUNOUZ promotions.
KOUNOUZ collects user information using cookies. The information is exclusively for KOUNOUZ and will not be disclosed to third parties.
Article 14 : LAW AND JURISDICTION
The GTS are governed by Moroccan law.
In case of dispute regarding the interpretation, execution, or non-performance of the GTS, Moroccan courts have sole jurisdiction.
